Content Creation Subscription Agreement

This Agreement is entered into between Era Media Company and the undersigned client. By enrolling in a subscription package and submitting payment, the client agrees to the following terms and conditions:

1. Services Provided

Company will provide recurring monthly content creation services according to the subscription package selected by the client:

  • Starter ($800/month): 2 hours of filming per month, 1 professional reel delivered weekly.

  • Foundation ($1,400/month): 4 hours of filming per month, 2 professional reels + 2 professional photos delivered weekly.

  • Influence ($2,100/month): 6 hours of filming per month, 3 professional reels + 4 professional photos delivered weekly.

Deliverables will be provided to the client via downloadable link every week.

2. Term & Renewal

This Agreement begins on the date of the client’s initial subscription payment and automatically renews each month unless canceled in accordance with Section 4.

3. Payment

  • Payments are collected via recurring ACH payment subscription through Stripe.

  • Client authorizes automatic monthly charges until the subscription is canceled.

  • Payments are non-refundable once services for that month have begun.

4. Cancellation & Rescheduling

  • The client may cancel at any time by providing at least 14 days’ written notice before the next billing cycle.

  • Unused filming hours in a given month do not roll over.

  • Filming sessions must be scheduled at least 3 days in advance and are subject to Era Media Company availability.

5. Client Responsibilities

Client agrees to:

  • Provide timely access, availability, and information needed for filming.

  • Secure all necessary permissions for filming locations, talent, or third-party use.

  • Review and approve content within 7 days of delivery (after which it will be deemed accepted).

6. Confidentiality

Both parties agree to keep all confidential business, marketing, or proprietary information shared during this Agreement private and not disclose it to any third party without prior written consent, except as required by law. This obligation survives termination of the Agreement.

7. Ownership & Usage Rights

  • Client owns the final delivered reels/photos once full payment is received.

  • Era Media Company retains the right to use delivered content for its portfolio, marketing, and promotional purposes unless the client opts out in writing.

  • Raw footage and project files remain the property of the client and will be kept and stored by Era Media for content creation purposes.

8. Late Payment & Failed ACH

  • If a scheduled ACH payment fails, the client will be notified and given 5 business days to update payment information.

  • Services may be paused until payment is successfully processed.

  • If payment is not received within 10 business days, Era Media Company reserves the right to suspend or terminate this Agreement.

  • A late fee of $50 may be applied to overdue invoices.

9. Scheduling & Missed Sessions

a. Client Cancellations or No-Shows

  • If a client fails to schedule their monthly filming session within the billing cycle, those hours are forfeited and will not roll over to the following month.

  • If Client cancels or does not attend a scheduled filming session without providing at least 24 hours’ notice, that session may be forfeited at Era Media Company’s discretion.

  • Era Media Company will make reasonable efforts to reschedule if the client provides timely notice, subject to Era Media’s availability.

b. Company Cancellations or Inability to Perform

  • If Era Media Company is unable to perform scheduled services due to illness, emergency, equipment failure, or other unforeseen circumstances, Era Media will notify the client as soon as reasonably possible.

  • In such cases, Era Media Company will reschedule the session at no additional cost to the client, or, if rescheduling within the billing cycle is not possible, Era Media Company will provide a credit toward the next month’s subscription or issue a prorated refund for the missed session, at the client’s election.

c. Mutual Cooperation

  • Both parties agree to communicate promptly regarding scheduling changes.

  • Neither party shall be held liable for delays or cancellations caused by events beyond their reasonable control (e.g., natural disasters, acts of government, or other force majeure events).

10. Liability & Limitations

  • Era Media Company is not liable for indirect, incidental, or consequential damages.

  • Era Media Company’s maximum liability under this Agreement is limited to the amount the client paid in the month of the issue.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Pennsylvania.

By submitting payment, the client acknowledges they have read, understood, and agree to these terms.
